Quarantine

Maybe this needs to be in the other section.  I want to know how can we that live close to neighboring states attend a contest or fun fly in which a state requires a 14 day quarantine to be in their state.  I live within a few miles of the state of Missouri and they have an area which has control line flying as part of an RC field in a park.  I also have relatives that live in Missouri.   The reason I ask is how do the people of the neighboring states of New York get around their idiotic rule or was it New Jersey.

I would point out that the Founding Fathers instituted quarantine in 1776 during a smallpox epidemic. And again in 1777 then again in 1779. For again smallpox then yellow fever. Even sent in troops to prevent people from leaving an area. It's not unconstitutional, just largely ineffective as people are basically selfish and won't follow the rules anyway.

We debated just this issue in my constitutional law course although that was a half century ago.  Our consensus, (in other words  - what the professor told us) was that what you say is true outside of the specific rights spelled out in the constitution protected by the supremacy clause.   What these governors are doing is basically declaring Martial Law within their states.  That will work for the State constitution but it still does not suspend the US Constitution.  We had a big issue with vaccinations some years back here in Texas.  I think the final resolution was that they could be required for admission with religious and medical exemptions.

Was that quote from the "Constitution" or a legal opinion from a Federal Court?  You can find a constitutional law office to support just about any interpretation you want but unless it is in the constitution or a legal ruling, it is just an opinion.

  Except that they aren't doing that. Even then, infringing on enumerated rights requires a strong legal argument that has not be made. The *Civil War* was inadequate to allow Lincoln to suspend habeas corpus, he got slapped down on that one.

Too Many democratic governors, including here in PA have power egos.  They enjoy ordering people around if they can, rather  than talking a difficult Legislature into passing what they want.

It's always easier to say "NO", than "yes" because "yes"  give some sort of approval and they HATE being caught out approving something silly.  They might regret supporting CO2 limits in just a few years if we have a very possible cooling period!

It's from Laurence Tribe - Constitutional Law professor at Harvard. He runs the constitutional think tank there. Found it through my old school. And you're right. Flying over state lines is one thing driving across state lines is another.  Are there road blocks on the state lines??   If so what proof do you have that you are following the rules?  It's like the stupid drone rules and control line flying.  Who cares and who is going to check.   I go about my dally life, not in fear, but with caution to minimize conflict with John Law.

Another thing, what is the punishment for crossing the state line?  It all so dumb!!!!

Does anybody remember whether there was a quarantine in 1918-1920 for "The Great Influenza"? That one cost me one of my Grandfathers. It was brought home from Europe by our "Doughboys" after WWI ended.     Steve

1. I have not read every post. I am only responding the question that was asked of me...
The question Ask was where does the governors of the state get the right to violate the constitution. I have to wonder where in the constitution you think that wearing a mask is specifically covered. And second I have to wonder why you think your rights do not end when it affects others. You can only swing your fist so far until it stops just short of hitting some one. So they have the right to impose rules in times of such concerns to prevent that. DO you think, that had they known that Locking up Mary Mallon in the 1800's would have resulted in the saving of hundreds of lives  would have been done in spite of desire to help ? And we are not talking about people trying to help today but people of just do not Care about the health of others because they are either misinformed or miseducated. Analogy The mask you wear is akin to the net on a soccer goal. A single molecule of hydrogen sulfate is akin to a ping pong ball. It goes right through. The Covid-19 virus on a water droplet is akin to a Honda Odyssey. It gets stopped by the net. So if you are asymptomatic you stop spreading it is you wear a mask. Since not everybody is being tested because Trump thinks testing means more cases...we all need to wear a mask to help. My in-laws have both come down as being positive. So yes It is a concern to me since they normally watch our grandkids and my wife has health risks. Trying to claim that wearing a mask is akin to socialism is just crazy. I am an atheist. But when I was a believer I know full well that caring for your fellow man was top priority period. If there were a Jesus. He would say to do it period.

My wife and I drove from south Louisiana to Connecticut to spend Thanksgiving week with our daughter and family. We passed through 12 states on the journey spent the night in Tn and Va and 6 days in a hotel in Ct. We drove all over our old stomping grounds visited several friends and restaurants and stores. The Saturday after Thanksgiving we re traced the route home and got back into our regular routine. No tests no quarantine no contact tracing no problems. I did find that a lot of people are scared shitless and are listening to politicians rather than using common sense. The politicians are killing you just to get at Trump.
